Privacy Statement

The Operator has set up this Privacy Statement to inform the Users of the Website and to demonstrate the commitment to privacy of data while providing the Services as outlined in the Website.

 

1.            Collecting Information

a.            Website Data

When accessing the Website some information regarding the surfing behavior of the User (e.g. IP-address, date and time of access, name of files accessed, etc.) is automatically recorded. Such data may be stored and used for statistical analysis by the Operator or may be evaluated by a third party by order of the Operator, even if such data is not part of a finalized Booking.

1.            Cookies

To optimize the running of the Website the Operator uses so-called cookies, which, as part of the browser software, record certain data regarding the use of the Website on the computer of the User. This allows the Operator to recognize the computer of a User returning to the Website. The Users, however, may change the settings of their browsers so that the computer does not accept cookies or will only accept them with the User's authorization.

2.            Google Analytics Data, Pixel-Tags, Web-Bacon, Clear GIFs

This Website uses Google Analytics, a Website analysis Service offered by Google Inc. Google Analytics uses various technical processes to transfer and secure data regarding the use of the Website to Google. Google provides this information to the Operator of the Website so that the latter may produce reports regarding the Website activity. By using this Website you agree to Google processing data collected on your activities.

b.            Collecting User Data when Booking a Service or at Registration

When registering or booking Services the information provided by the User is recorded or, if the User is already registered, it is updated. For this purpose only the information required in connection with a specific Service offering will be requested and recorded:

• Firstname, Surname, Date of Birth, Address, Phone numbers, e-mail;
• Login-Name, Password, Traveldates, Flt-No., Airline, Airport, Purpose of Visit;
• Date, time and content of the Services, Extras and Requests booked;
• Remarks of the User regarding his Booking in the open description fields;
• Payment information for payments with credit card.

 

2.            Personality Profile and Personal Data Subject to Enhanced Legal Protection

a.            Personality Profile

The Operator expressly makes the User aware of the fact that the collection of data may represent a so-called Personality Profile according to the Swiss Data Protection Ordinance. A Personality Profile is a collection of data, which may allow the assessment of essential characteristics of the User's personality.

b.            Personal Data Subject to Enhanced Legal Protection

It is possible that the Operator may come into possession of data that is considered personal data subject to enhanced legal protection by the Swiss Data Protection Ordinance. Such as, if the User through his own "private message board" provides information regarding meals requested or medical needs, which may be important for the planning of the Service, however, under certain circumstances will allow conclusions regarding religious belief, race or health of the User. Information subject to enhanced legal protection, will be used only for providing the requested Service.

c.            Express Authorization for Data Collection and Processing

With the Registration, Booking of a Service and login on the Website the User expressly authorizes the Operator to collect and process all above mentioned data, the personality profiles and the data subject to enhanced legal protection for the purpose of providing certain Services.

 

3.            Data Security

The personal data gathered by the Operator will be protected appropriately in accordance with the provisions of the Swiss Data Protection Ordinance with regard to confidentiality, integrity and availability of the data.

 

4.            Use of Data

a.            For Processing Services and the Analysis of Website Use.

The data provided by the User will only be used for processing the booked Services as well as for the purpose of analyzing data in connection with the use of the Website.

b.            Use for Marketing Purposes.

The data provided will allow the Operator to provide Users with personalized offers and information that may be interesting to them. In the User Profile the User can indicate at any time if he would rather not receive such offers, information and Newsletters.

 

5.            Transmission of Data to Third Parties

a.            To Agents, Service Providers, Authorities

The Operator is the owner of the data and in compliance with the provisions of the Data Protection Ordinance may transmit the data to third parties that collect, store or process this data within the scope of a contractual relationship. Moreover, the data of the User will be treated confidentially and will not be provided to unconcerned third parties, unless it is required by applicable law and where requested by the responsible authorities or necessary for the protection or enforcement of the interests of the Operator or one of its agents.

b.            In Countries Outside the EU without Equivalent Data Protection.

Data may also be transferred to countries without the same level of legal data protection requirements as in Switzerland.

c.            Express Authorization for Transferring Data to Third Parties, also Abroad

The User expressly authorizes the Operator to transfer data, including personality profile and data subject to enhanced legal protection to third parties and under certain circumstances also to countries that do not dispose of data protection regulations equivalent to Swiss provisions.

 

6.            Access to Personal Data

The User may access, update or correct the saved User Profile containing his personal information at any time. By merely ticking the appropriate box the User can subscribe or unsubscribe from the transmission of offers and information for marketing purposes at any time.

 

7.            Authorization for Electronic Communication

At present electronic communication (E-mail, Chat, Blog, Forums, etc.) with or through the Website or with the Operator takes place in an open network that is accessible to anyone and also across borders. Moreover, it is unencrypted. It cannot be excluded that third parties may view the data transmitted in such manner and that contact to the Website or to the Operator may be traced. Discretion is therefore not assured with regard to electronic communication. The User acknowledges this, is aware of this fact and herewith expressly agrees to the use of electronic communication.

 

8.            Right to Delete Data

The Operator is authorized, but not obliged, to delete User Profiles and data of Users that have not logged in to the Website for more than 12 months, or of Users that have misused or tried to misuse the Website, without further inquiry. The Operator waives all responsibility or liability in connection with the deleted content. Data backup is expressly the User's responsibility.
